The term BKR registration sounds pretty familiar to us. We also know that you can get one when purchasing a new smartphone and that it has consequences for the application for your mortgage. But what exactly is a BKR registration? And once you have one, how do you get rid of it ? In this article we tell you everything you need to know about a BKR registration. What is a BKR registration?
A credit or loan that you take out with the bank or online will be registered in the Central Credit Information System of the BKR foundation. We simply call that a BKR registration. This way it becomes clear how many loans you have taken out. It is also visible whether you have already repaid it or perhaps have a payment arrears.
Every time you want to apply for a new loan, a lender is required to first request your details that are known to the BKR foundation. After seeing your details, they can determine whether it is still justified to provide you with a new loan. Registering loans and credits is not only done in the Netherlands, it is done in many European countries. Such a system of credit registration promotes the financial well-being of the population. Loans can therefore be taken out easier and cheaper in countries with credit registration than if no credit registration takes place.
Many people think that a BKR registration is disadvantageous.
That is not true.
The word ‘BKR registration’ does not have such a positive impact on most people. This is a misconception that we are happy to resolve. If you do not have payment arrears, a BKR registration is only proof of good financial conduct. The lenders who request your BKR data and see that you have no payment arrears will be happy to do business with you. You can compare it to requesting a Declaration of Behavior. If you do not have a criminal record or something to hide, such a VOG will not cause you any problems.
Consequences of a BKR registration
We now know that a BKR registration only has negative consequences when you build up payment arrears. At that time, a lender may offer you a lower loan or decide not to offer you a new loan. Purely to protect yourself against even more debts. In this way, we are working on a financially healthy Netherlands. Even when it will not have any negative consequences, we are still curious about what a BKR registration in relation to a mobile phone and mortgage actually entails.
BKR registration when purchasing a telephone
Since 1 May 2017, telephone credits have also been reported in the Netherlands . But not every telephone subscription will be registered with BKR. This only happens when you take out a subscription, including an installment device, of more than 250 euros. A device that you buy on credit is listed at the BKR foundation under the name ‘descending credit’ (AK). Suppose you buy a device of 850 euros on installment, then this is also the amount that is recorded as descending credit.
This is a so-called ‘positive registration’. It is only recorded that you have purchased an installment device. If you pay on time, you will continue to be known positively. It will have no effect whatsoever on the way in which lenders judge you. Do you not pay on time or not at all? Then you get an A-coding after your name, which stands for backlog coding. This may make it harder to take out a new loan.
If you have paid off your new smartphone in full, an end date will be placed. This way it is clear that your credit has ended. The credit remains in the system of Stichting BKR for five years after the end date.
Mortgage application with a BKR registration
When you apply for a new loan or mortgage, a financial check is first made by the lender. The previously taken out loans can be viewed at the BKR foundation. Your income and other financial obligations determine whether you will receive the loan. To calculate exactly how much you can borrow, the lender uses laws and agreements made with the government. For example, a borrowing standard has been set by Nibud that specifies how much you can borrow with your income.
Are you about to apply for the loan or mortgage? Then ask for your overview at the BKR. The mortgage adviser (note: this is not the lender) cannot view the overview independently and cannot include that data in his advice, unless you provide it.
After you have repaid the loan, the data will remain visible for five years at the BKR foundation. There is also a neat end date with the data, so that you can see that the loan has been fully repaid. In this way, a lender sees that you have had a loan in the past, repaid it and now have (more) financial room again.
Request BKR registration
For security reasons and to protect your privacy and that of others, it is only possible to request your own data. Information from others can only be requested as administrator or surviving relative. You can request your data online free of charge. The BKR uses iDIN to let you log in. This is a service that allows you to log in securely via your own bank. It is a safe, fast and free way to identify yourself.
When you make a request for access and your data can be found directly in the CKI, you will receive online insight into your data within a few minutes. If your data cannot be found immediately, it is because they differ from the data currently known to the BKR. It will then take a little longer for you to gain insight into your data. The BKR will keep you informed of further developments.
What does BKR know about you?
Now you may be wondering what exactly the BKR knows about you and what you see when you request your data. You will see which loans you currently have and which you have had in the past five years. A mortgage will be registered from the moment you have more than three months of payment arrears.
This is known about you as a person:
- Initials and birth name
- Date of birth
- Address, zip code and city
This is known about your loan (s):
- The type of loan
- The amount of the loan
- The starting date of the loan
- The month in which the agreement is repaid
- The month in which the agreement is terminated
- Any details during the term
This is NOT known:
- Your income
- Possible debts (rental debt, tax debt, current accounts)
- Study debt
Manual: delete BKR registration
If you have ever taken out a loan or credit, your details will be stated in the Central Credit Information System. Now it is possible that you disagree with this entry and prefer to delete it. You cannot simply delete this. But when you have good reason to have the data removed, there are various actions you can take to do something about your BKR registration.
Have BKR registration removed
If you have repaid your loan in full and the contract with the lender has been terminated, your details will remain with the BKR for another five years. Here is an end date that makes it clear to any other lenders that the loan has been fully repaid. Do you have the impression that incorrect information is stated at the BKR. Or do you want to get rid of your BKR registration earlier than these five years, go through the following steps. In both cases you take the same steps.
STEP 1: Make your own objection
Before you start taking steps to have any data removed, it is necessary that you have first viewed the data. You must be sure that something is wrong or have a good reason why you want data deleted. The BKR is not authorized to change or delete data just like that, therefore you will have to contact your lender and send them a request.
In this request you explain why you do not agree with the BKR registration. You clearly describe the impact of the BKR registration. Add relevant documents that prove you are right. Send the request including accompanying documents to your lender. If something turns out to be wrong and your data is indeed wrong in the system, the lender will have to adjust this for you.
STEP 2: The Disputes Committee
Can’t get out with the lender? Then you can appeal to the Disputes Committee. This committee consists of independent judges from the Amsterdam court. They can make a binding statement that everyone must then adhere to. The lender, the BKR and you will have to accept the decision of the Disputes Committee.
STEP 3: Hire an independent company
Deleting a BKR registration is not done in ‘Jip & Janneke language’, many legal terms are used for this. Have negative BKR registration removed
It is also possible that you do not agree with a negative BKR registration. This registration will have more consequences than a positive BKR registration. That is why it may be even more important for you to have incorrect data corrected as quickly as possible. If you do not agree with the negative BKR registration, contact your lender immediately. If you cannot resolve it together, you can appeal to the independent Disputes Committee.
Beware of having it removed online
When you search for ‘have BKR registration removed’, you will come across various parties that make you an offer. Be careful with these parties. The fact is that it costs you a lot of money in advance, but that a good outcome is not guaranteed. The result is certainly not always a deletion of your registration.
Do you have the idea that you have an incorrect registration? Then it is possible to have it corrected by the BKR. You may also suspect that there is wrong information on your overview. This information is supplied by the lender in this way. The BKR can therefore not change this data independently. In this case, contact the relevant lender and ask them to change the details.
How do you prevent a negative BKR registration?
If you pay too late, you will not immediately receive a negative BKR registration. First you will receive a reminder from the lender and then reminders. If you ignore all these warnings, you will receive an official advance notice in which the lender makes it clear that he is going to make a Back Report to the BKR Foundation. If this pre-announcement is also ignored, the lender is forced to make a report. As a result, you have a negative BKR registration in your name.
After you have repaid the loan, there are two options to choose from.
- Keep the contract running. You choose to continue the contract in which you incurred a negative registration. You will then receive a Recovery Report. There is now an H behind the loan.
